Terms of Service

1. Acceptance of terms

These Terms of Service govern your access to and use of Nexith — our model, applications, and API. By creating an account or using the service, you agree to these terms. If you are using Nexith on behalf of an organization, you agree on its behalf.

2. Your account

You are responsible for keeping your account credentials and API keys secure, and for all activity that occurs under them. Notify us promptly if you believe a key has been compromised. You must be able to form a binding contract to use the service.

3. Acceptable use

You agree not to use Nexith to break the law, infringe others’ rights, or generate content that is harmful or abusive. You may not attempt to disrupt or reverse-engineer the service, circumvent rate limits or security controls, or resell access in violation of these terms.

We may suspend or limit access that threatens the security, integrity, or availability of the service.

4. Your content

You retain ownership of the inputs you send and, as between you and us, the outputs you receive. You are responsible for your inputs and for how you use outputs. As stated in our Privacy Policy, we do not use your prompts or outputs to train our models.

5. Fees and billing

Paid plans and usage-based charges are billed as described on our pricing page. Usage is metered by tokens processed, and charges accrue as you use the service. Fees are non-refundable except where required by law or expressly stated.

6. Availability and changes

We work to keep the service reliable, but it is provided on an “as available” basis and may change over time. We may add, modify, or discontinue features, and we will give reasonable notice of material changes where we can.

7. Disclaimers

AI-generated output can be inaccurate or incomplete. You should review outputs before relying on them, particularly for important decisions. The service is provided “as is,” without warranties of any kind to the extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Nexith is not liable for indirect, incidental, or consequential damages, or for lost profits or data, arising from your use of the service.

9. Termination

You may stop using the service and close your account at any time. We may suspend or terminate access if you breach these terms or to protect the service. Provisions that by their nature should survive termination will do so.

10. Changes to these terms

We may update these terms as the product and our obligations evolve. When we make material changes, we will update the date above and, where appropriate, notify you. Continued use after changes take effect means you accept the updated terms.
